The business of Andcom 26 cc T/A Yocal is marketing and involves the collection of Personal Information from individuals who may be interested in a specific type of service, and the sale of this personal information to our clients, who are businesses that provide services in the area for which the personal information was collected.
We use advertising, for example on social media sites, to attract individuals that may be suited for business products or services of our clients. We are up front and open about what we do, and this Privacy Policy sets out how we collect your personal data, what we do with it, who we give it to, how we keep it safe and how long we store it for. DEFINITIONS
When we talk about ‘us’, we mean Yocal and the entity detailed in the Schedule. We are the operator of this website. When we talk about ‘you’, we mean the person using this website or services of this website or participating in any surveys, questionnaires or quizzes produced by this website. When we talk about ‘client’ we mean the business or businesses that engage or deal with us to purchase the information we collect.
‘Personal data’ or ‘personal information’ is information that directly identifies you, such as your name and email address, or data that could be used, on its own or in combination with other data, to identify you.
It is very important to us to protect your personal data and to use it strictly in adherence with applicable privacy and data protection laws.
OUR ROLE
Yocal is the “Responsible Party” for your personal information when we decide its processing operations. In most instances we operate as an “Operator” of personal information on behalf of a client who uses our services for their organisation. In these circumstances, the client’s privacy policy or statement will apply to the processing of personal data.
We have appointed an information officer at Yocal who is responsible for overseeing questions in relation to this Privacy Policy. If you have any questions about this Privacy Policy, including any requests to exercise your legal rights, please contact our information officer using the details set out below.
You have the right to make a complaint at any time to the South African regulator’s office (Information Regulator’s Office of South Africa). We would, however, appreciate the chance to deal with your concerns before you approach any such regulator, so please contact us in the first instance.
STAYING ANONYMOUS
You can browse our website anonymously, although cookies may be collected. You will not be able to access surveys or questionnaires anonymously.
THIRD PARTY LINKS
Our website may include links to third-party platforms, plug-ins, and applications. Clicking on those links or enabling those connections may allow third parties to collect or share information about you. We do not control these third-party platforms and are not responsible for their privacy statements or terms. When you leave our website, or engage with such third parties, we encourage you to read the distinct privacy policy of every third-party you engage with.
COLLECTION OF DATA
Yocal aligns its definition of “personal information” or “personal data” with that as set out in the Protection of Personal Information Act, 2013 (POPIA). All information specific to you that is provided to us via our website or through any other way will be classified as personal information. This includes but is not limited to personal information that is provided to us through the completion of a debt assessment survey, obtaining an online quotation, enquiries via e-mail or mobile or shared with us from a third party.
Due to the nature of our services, we may process special categories of personal information as a responsible party. We may also process such data under instruction as an operator where our supplier or client will remain the responsible party of such personal data and provides us with limited access insofar as necessary to provide our services.
This includes but is not limited to the following personal information that you may provide to us:
• Your name and surname;
• Email address
• Contact details
• Age and Gender
• Employment status
• Homeowner status
• Lending, lending amount, time period and past lenders
• Other debts (Council tax debts or Personal debs)
We may also process the following information of anyone that interacts with us:
• Social media data including all the data available on your publicly available social media profile;
• Financial data bank account details;
• Transaction data including details about payments to and from you, contracts, contractual terms, contract fees, signups, subscriptions, invoices and other details of products and services you have obtained from us, or provide to us;
• Technical data including internet protocol address/es, login data, browser type and version, time zone setting and geo-location, cookies, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access the Platform;
• Usage data including information about how you use our company, website, surveys, and services; and
• Marketing and communications data including your preferences in receiving notices and marketing from us and our third parties and your communication preferences as well as details of which communications were sent to you and how they were sent.
We may collect your personal information either directly or indirectly.
We will collect your information directly when you interact with us via our website, complete a debt assessment survey, obtain an online quotation, enquire with us via e-mail or telephone or interact with us on social media.
We may also receive your information from third party suppliers who share your information with us, with your consent such as advertisers and lead generation agencies.
USE OF DATA
We may process personal information for various reasons which include by way of consent, for our legitimate business purposes, pursuant to a contract in place between us or where legally required. Our core business is that of a lead broker and aggregator on behalf of clients.
We process personal data to engage with our clients and provide them with our services and the services of third parties. We also process personal data to contract with third parties including suppliers and software service providers.
The majority of our processing involves sharing your personal data with our clients who may use your personal data to contact you about products or services they deliver or sell that are compatible with the reason you provided your personal data. It allows us to align the products and services of our clients as closely as possible to your needs and situation. Our clients may then contact you to offer or market their services to you. Where we collect your personal information directly, we will always ensure you provide your consent for such sharing in line with POPI. Where we receive your information from a third party, we ensure they warrant to us that they received your consent to share your information with us.
Once we share your personal data with our client, that client becomes the responsible party of your personal data and they will treat your personal data in accordance with their privacy policy. Once your personal data has been shared to our client, we do not process your data and are no longer the responsible party for the personal data.
We process financial data to process and service your payment for any services we render and to manage payments, fees, and charges. We also process financial data for our legitimate business purpose to ensure we are able to run our business and provide our services under the contract we have with you.
We may also process your usage and transaction data for our legitimate business purpose to monitor and improve our website as well as to notify you about changes to our website and services.
We will also disclose your personal data where legally compelled to do so to meet our regulatory and compliance requirements.
We will only use your personal data for the purpose for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us.
If we need to use your personal information for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.
Please note that we may process your personal information without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.
MARKETING
We strive to provide you with choices regarding marketing and advertising. To manifest your rights attached to any marketing sent to you as an existing client, please use the in-built prompts provided on those communications, or contact us.
You will receive marketing communications from us if you have requested our services, requested information from us, consented to your data being shared with us, or provided us with your details in any other circumstance and, in each case, have not opted-out of receiving that marketing.
You can ask us to stop sending you marketing at any time by using the built-in prompts or contacting us and requesting us to cease or change your marketing preferences. Where you opt-out of receiving these marketing messages, this opt-out will not apply to other personal information of yours which we process for another lawful basis or necessary communications we send when you use our services.
Whilst we may use your personal information within our company, we will get your express opt-in consent before we share your personal information publicly with any entity outside of Yocal for marketing.
STORAGE AND DISCLOSURE OF DATA
The personal data you provide to us is stored at https://www.leadbyte.co.uk which has strict security to ensure data protection, integrity, and confidentiality. While we do our best to ensure the security of your data, no storage is 100% secure and we cannot guarantee the safety of your data. From Leadbyte, your data is then transferred to our client. Such a transfer may include transfer of information across boarders depending on where the client is. This means your data may be transferred to, and stored, computers outside of South Africa and the data protection laws may be different from those where you live. By agreeing to this policy, you agree to such a transfer. We require all third parties to respect the security of your personal data and to treat it in accordance with the law.
Data is deleted from our storage at Leadbyte every 30 days. This means, if we have collected your personal data, we will delete it within 31 days.
Leadbyte have their own privacy policy in relation to how they manage and store your personal information.
COLLECTION OF DATA OF MINORS
We do not intend to collect the personal data of persons under the age of 18. If you are the guardian of a minor and suspect they may have provided us with their personal information, please contact us and request to have the minor’s personal information destroyed (use the contact information in the schedule below).
COOKIES
We may also use ‘cookies’ on our website to provide a way for the website to recognise you and keep a track of your preferences, and to enable you to contact us directly from the website. Cookies may also be used to optimise website speed for your convenience, to allow you to customize our web pages and so that you do not have to keep filling in your details repeatedly. We may collect information about your IP address and how you used our site.
That data collected by cookies does not usually identify you, but may be combined with other information to identify you. If we identify you using information from cookies, we may use that information to track how you use our website and send you information more specific to your needs, or to invite you to purchase one of our services.

DATA RIGHTS
At your request, we will tell you what personal data about you is being processed, on what basis, and by whom. If you decide your data should not be processed for one or more purposes, you may withdraw your consent from using your data in that way. Please note that we will action your request as soon as practically possible however such a request will not take effect immediately and you may still be contacted by our client in the meantime.
You may amend inaccurate, incomplete, or outdated personal data at any time by applying directly to us using the contact information below.
You may also request that all personal data we have collected about you be deleted from our records and erased from information stored by any third-party organisations processing data on our behalf. Should you wish for your data to be destroyed, please make a formal request.
If data we have collected about you is processed using automated means, you have the right to receive that data in a structured, machine-readable format and to transmit it to another data controller without hindrance.
